By accessing or using PatientChart AI ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and PatientChart AI.

2. Description of Service

PatientChart AI is an AI-powered clinical documentation platform that helps healthcare professionals generate, manage, and organize patient notes. The Service uses artificial intelligence to transform voice and text inputs into structured clinical documentation.

3. Eligibility

The Service is intended for use by licensed healthcare professionals and authorized staff within healthcare practices. By using the Service, you represent that you are at least 18 years old and have the authority to enter into these Terms on behalf of yourself or your organization.

4. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • You are responsible for the accuracy and legality of all data you enter into the Service
  • You must comply with all applicable laws and regulations governing healthcare documentation in your jurisdiction

5. AI-Generated Content Disclaimer

PatientChart AI is a documentation assistance tool, not a medical device. The AI-generated clinical notes are provided as drafts for your review. You acknowledge that:

  • All AI-generated notes must be reviewed, edited, and approved by a qualified healthcare professional before being finalized
  • The AI may produce errors, omissions, or inaccuracies that require correction
  • You bear sole responsibility for the accuracy and completeness of all clinical documentation
  • The Service does not provide medical advice, diagnosis, or treatment recommendations
  • PatientChart AI is not liable for any clinical decisions made based on AI-generated content

6. Subscriptions and Billing

The Service offers a 7-day free trial. After the trial period, a paid subscription is required to continue using the Service.

  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable except where required by law
  • We reserve the right to change pricing with 30 days' notice
  • Failure to pay may result in suspension or termination of your account
  • You can cancel your subscription at any time through your account settings

7. Data Ownership

You retain full ownership of all data you enter into PatientChart AI, including patient information and clinical notes. We do not claim any ownership rights over your content. You grant us a limited license to process your data solely for the purpose of providing the Service.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Share your account credentials or allow unauthorized access
  • Attempt to reverse-engineer, decompile, or extract the source code of the Service
  • Use automated systems to scrape or extract data from the Service
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to store data unrelated to healthcare documentation

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PATIENTCHART AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or experience downtime. We are not liable for any loss or damage caused by Service unavailability.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any reason with reasonable notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or in-app notification. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.
